  • Colors, finishes, and materials may appear differently depending on your device and settings.
  • You are responsible for confirming compatibility, load ratings, and local code compliance with a qualified professional (such as a certified installer, engineer, or licensed contractor).
  • All products are subject to availability, and we may limit or discontinue items at any time without notice.

5. Pricing, Promotions & Errors

All prices are listed in US Dollars (USD) unless otherwise noted.

  • We reserve the right to change prices, fees, and promotional offers at any time without prior notice.
  • In the event of a pricing, typographical, or other error, we may:
    • Contact you with updated information and ask whether you wish to proceed, or
    • Cancel your order and issue a refund for any amount already paid.

6. Orders & Order Acceptance

When you place an order, you are making an offer to purchase the products in your cart under these Terms.

  • If your payment is declined, reversed, or charged back, we may cancel your order or require an alternate form of payment.

You are responsible for any sales, use, value-added (VAT), or other taxes imposed by federal, state, or local authorities in connection with your purchase, where applicable.

9. Shipping, Delivery & Risk of Loss

We ship products to addresses within the United States (and any other locations we may specify on the Site from time to time).

  • Processing Time: Order processing times may vary based on product availability, order volume, and other factors. Estimated shipping or delivery times are not guarantees.
  • Risk of Loss: Title and risk of loss pass to you when the order is handed over to the carrier at our shipping location.
  • Delivery Issues: Once shipped, transit time and delivery are the responsibility of the carrier. We are not liable for delays, lost shipments, or damage occurring after the carrier takes possession, but we will reasonably assist you in working with the carrier to investigate issues.

Please inspect deliveries promptly and report any visible damage to the carrier and to us as soon as possible.

10. Returns, Refunds & Cancellations

Our return, refund, and cancellation terms are described in our separate Return & Refund Policy, which is incorporated into these Terms by reference. In the event of any conflict, the Return & Refund Policy will govern for return-related issues.

In general (subject to the full policy on the Site):

  • Certain products, including special orders, customized items, and installed or heavily used equipment, may be non-returnable or subject to a restocking fee.
  • Returned products must typically be in new, unused condition, in their original packaging, and include all accessories, manuals, and parts, unless otherwise stated in the Return & Refund Policy.
  • You are responsible for return shipping costs unless the return is due to our error (for example, incorrect item shipped), as defined in the Return & Refund Policy.
  • Refunds, when approved, are generally issued to the original payment method, minus any applicable fees, in accordance with our Return & Refund Policy.

11. Installation, Safety & Professional Use

Many of our products, including vehicle lifts and heavy garage equipment, must be installed, operated, and maintained properly to help reduce the risk of property damage, injury, or death.

  • You are solely responsible for ensuring that installation, assembly, and use comply with all applicable codes, regulations, and manufacturer instructions.
  • We strongly recommend that vehicle lifts and similar equipment be installed and inspected by qualified, licensed professionals familiar with local building, electrical, and safety codes.
  • Always read and follow the manufacturer’s manuals, warnings, and safety instructions. Never exceed rated load capacities or use products for purposes for which they are not intended.

Dunfer does not provide engineering, architectural, or professional safety advice. Nothing on the Site should be interpreted as a substitute for consulting licensed professionals.

12. Warranties & Disclaimers

Some products we sell may be covered by separate manufacturer warranties. Any such warranties are provided solely by the manufacturer, not by Dunfer, unless expressly stated otherwise.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

Without limiting the foregoing, we disclaim all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, as well as any warranties arising out of course of dealing or usage of trade.

To the maximum extent permitted by law, in no event shall Dunfer, Cobra Stone Inc., our officers, directors, employees, agents, or affiliates be liable for any:

  • Indirect, incidental, consequential, special, punitive, or exemplary damages; or
  • Loss of profits, revenue, data, goodwill, or business opportunities,

arising out of or in connection with your use of the Site, products, or services, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

To the extent our liability is not lawfully excluded, our total aggregate liability for any claim related to the Site, products, or services shall not exceed the amount you actually paid to us for the specific order giving rise to the claim.

You agree to indemnify, defend, and hold harmless Dunfer, Cobra Stone Inc., and our officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your violation of any third-party rights, including intellectual property or privacy rights.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on the Site except as necessary to view and use the Site for your personal, non-commercial use. Any unauthorized use may violate applicable laws.

16. User Content & Reviews

If you submit reviews, comments, photos, or other content (“User Content”), you grant Dunfer a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media.

You represent and warrant that:

  • You own or control all rights in and to the User Content;
  • Your User Content is accurate and does not violate these Terms or any applicable law; and
  • Your User Content does not infringe any third-party rights, including intellectual property, privacy, or publicity rights.

We may remove or refuse to display any User Content at our sole discretion.

The Site may contain links to third-party websites or services that are not owned or controlled by Dunfer. We are not responsible for the content, policies, or practices of these third parties. Accessing any third-party sites is at your own risk, and you should review their terms and privacy policies.

  • For any unlawful purpose or to solicit others to perform unlawful acts;
  • To violate any international, federal, state, or local regulations, rules, or laws;

We shall not be liable for any failure to perform or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disputes, war, terrorism, governmental actions, interruptions of internet or utility services, or supply chain disruptions.

21. Governing Law & Dispute Resolution

These Terms and any disputes arising out of or relating to your use of the Site or purchase of products shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

You agree to first attempt to resolve any dispute informally by contacting us at contact@dunfer.com. If we cannot resolve the dispute informally, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in or serving Williamson County, Texas, and you hereby consent to the personal jurisdiction of such courts.

22. Changes to the Site & These Terms

We may update, modify, or discontinue any part of the Site, products, or services at any time without prior notice.

We may also revise these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page. Your continued use of the Site after any changes signifies your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Site.

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be enforced to the fullest extent permitted by law, and the remaining provisions shall remain in full force and effect.

These Terms, together with any other policies or terms referenced on the Site (including our Return & Refund Policy and Privacy Policy), constitute the entire agreement between you and Dunfer regarding your use of the Site and purchase of products and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
